Telehealth now a permanent option within the NYS workers' compensation system

The Chair has adopted the addition of section 325-1.26 to Title 12 of the NYCRR to establish telehealth as a permanent part of the workers' compensation system, replacing the previous emergency regulations that allowed for telehealth during the COVID-19 pandemic.

The new regulation took effect July 11, 2023.

Board clarifies rules for submitting evidence via USB flash drive

As of August 29, 2022, the Board no longer accepts video evidence via DVD-R, as it must be submitted through a USB flash drive.

Submission of materials via USB flash drive is only permitted for video evidence (and any materials related to said evidence). If a party sends the Board a USB flash drive without any video evidence (or materials related to video evidence), the submitter will be informed that they must resubmit the contents of the USB drive through one of the approved methods described on the Forms page of the Board's website.

If the party chooses to resubmit the contents of the USB flash drive to the Board's centralized mailing address, they must print the materials and mail paper copies to the Board.

Updates to disability benefits regulations

The Chair has adopted amendments to sections 355.4, 363.1, 363.11, 363.13, and the addition of sections 363.15 and 363.16 to Title 12 of the NYCRR to update and clarify the disability benefits regulations and disability benefits claims process, conform the regulations to the statute, and align several sections with Paid Family Leave.

Interested in treating injured workers? If you are interested in applying for Board authorization to treat injured workers, the process is easy and is done online. Read more about becoming authorized here on the Board's website.
