Changes to Schedule Loss of Use (SLU) / EC-81.7 Process

The Board recently implemented a new process for Schedule Loss of Use awards as well as changes to the related EC-81.7 form.

These changes are detailed in a Board announcement dated November 8, 2022, along with an important update to the process timeframe requirements.

Adoption of Amendments to 12 NYCRR 324.3(a)(1) (Special Services)

The Chair has adopted amendments to 12 NYCRR 324.3(a)(1) to ensure that sacroiliac joint (SIJ) fusion and peripheral nerve stimulation (PNS) are not performed unnecessarily, and that if these procedures are medically necessary, that a Special Services Prior Authorization Request (PAR) for them has been submitted, and an authorization obtained.

Revision to Subject No. 046-237R Video Recorded Evidence

The Board will no longer be accepting video evidence via DVD-R and will be transitioning to receive video evidence via USB flash drive. DVD-Rs will be accepted for 60 days following this announcement. If a video is received via DVD-R after the end of the 60-day period, the submitter will be informed, and they will need to re-submit the evidence via USB flash drive.

Proposed Amendments to 12 NYCRR 355.4, 363.1, 363.11, 363.13, and Addition of 12 NYCRR 363.15 and 363.16 (Disability Regs Update)

The Chair proposed amendments to sections 355.4, 363.1, 363.11, 363.13, and the addition of sections 363.15 and 363.16 of Title 12 NYCRR to update and clarify the disability benefits regulations and disability benefits claims process, conform the regulations to the statute, and align several sections with Paid Family Leave.

Emergency Adoption of Amendments to 12 NYCRR 325-1.8, 329-1.3, 329-4.2, 333.2, and 348.2 (Telemedicine)

The Chair has adopted, on an emergency basis, amendments to 12 NYCRR 325-1.8, 329-1.3, 329-4.2, 333.2, and 348.2 to allow telemedicine in some circumstances. These amendments supersede the previous emergency telemedicine adoption to keep telemedicine in effect during the regulatory process for the permanent telehealth proposal.
