Subject Number 046-406 Temporary Suspension of Dr. Gerardo A. Yanayaco's Authorization to Treat Workers' Compensation Claimants Remains in Effect

Please be advised that, effective September 30, 2008, the Commissioner of Health, New York State Department of Health, issued an Order and Notice of Referral Proceeding (Summary Order) regarding Dr. Yanayaco's medical license (Reference No. CO-07-11-6621-A). By that Summary Order, Gerardo Asdrubal Yanayaco, M.D., was precluded from the practice of medicine in New York State or in any jurisdiction where the practice of medicine is predicated on a valid New York State medical license. Previously, by Subject Number 046-295, dated February 23, 2009, the Chair of the New York State Workers' Compensation Board issued notice of its action to temporarily suspend Dr. Yanayaco's authorization to treat, effective February 12, 2009, until February 11, 2010. Subject Number 046-295 also served as notice of the summary prohibition by Summary Order, effective September 30, 2008. This Order remains in effect unless modified or vacated by the New York State Commissioner of Health, neither of which has occurred to date. Since the Order remains in effect, Dr. Yanayaco remains precluded from practicing medicine in this state or any other jurisdiction where the practice of medicine is predicated on a valid New York State medical license. No current business address is available for Dr. Yanayaco.

Based on the summary prohibition from the practice of medicine, which remains in effect, Dr. Yanayaco is prohibited from rendering medical treatment and care to individuals who have suffered work-related injuries or illnesses. Medical reports submitted by Dr. Yanayaco for treatment rendered prior to September 30, 2008, are valid, but are invalid for any treatment rendered on or after that date. Requests to cross-examine Dr. Yanayaco regarding treatment he rendered prior to September 30, 2008, should not be denied to the summary prohibition from the practice of medicine.
