Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Samuel R. Walters’ authorization to treat injured workers within the New York State workers’ compensation system effective June 13, 2016. Dr. Walters’ last known business addresses are 953 Southern Boulevard, Suite 302, Bronx, New York 10459, 615 Seneca Avenue, Ridgewood, New York 11385, 804 Washington Street, Peekskill, New York 10566, and 10825 Merrick Boulevard, Jamaica, New York 11433.
The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Order # 16-172, wherein Dr. Walters could not successfully defend against at least one act of misconduct alleged, including delegation of professional responsibilities to licensed professionals unqualified by training and/or experience to perform electro-diagnostic testing, and improper submission of bills for reimbursement for invalid testing, resulting in a limitation on his license to preclude him from evaluating, treating or billing patients whose services are reimbursed through No-Fault insurance, a 36-month probationary period, and a $10,000 fine.
Therefore, the Chair believes that Dr. Walters may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.
Dr. Walters is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Walters for services rendered prior to June 13, 2016, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Walters for services rendered prior to June 13, 2016, should not be denied due to the suspension of his authorization.
This suspension remains in effect until further notice. Any questions regarding the authorized lists should be referred to the Medical Director’s Office at 1 (800) 781-2362.
