Subject Numbers Regarding Health Provider Authorizations

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Michael Sacher’s authorization to treat injured workers within the New York State workers’ compensation system effective March 12, 2015. Dr. Sacher's last known business address is 1176 Fifth Avenue, New York, NY 10029.
The Chair’s designee’s investigation revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) issued Order # 14-150, wherein between June 2011 and February 2012 Dr. Sacher ordered prescription medication for individuals that were not patients in his radiology practice. These recipients were family members, friends, co-workers and professional colleagues. He deviated from medically accepted standards in that he failed to conduct adequate evaluations of the patients and failed to maintain a record that accurately reflects his evaluation.
As a result, Dr. Sacher’s license was suspended for thirty-six months, stayed with probation for thirty-six months. He has permanent conditions whereby he must comply with medically accepted standards for prescribing medication and must maintain a prescribing log in a format that is acceptable to the Office of Professional Medical Conduct.
Therefore, the Chair believes that Dr. Sacher may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.
Dr. Sacher is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Sacher for services rendered prior to March 12, 2015, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Sacher for services rendered prior to March 12, 2015 should not be denied due to the suspension of his authorization.
This suspension remains in effect until further notice. Any questions regarding the authorized lists should be referred to the Medical Director’s Office at 1 (800) 781-2362.
