Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Eleanor Lipovsky’s authorization to treat injured workers within the New York State workers' compensation system effective July 1, 2014. Dr. Lipovsky's last known business address is 30 Bay Street, Suite 202, Staten Island, New York 10301.

The Chair's designee's investigation revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC), issued Order # 14-138, effective June 5, 2014, wherein Dr. Lipovsky did not contest the charge of having been convicted in Supreme Court, Kings County, New York, of Criminal Facilitation in the Fourth Degree. Dr. Lipovsky was penalized with a censure and reprimand and fined $3,000.

Further investigation revealed BPMC Order # 04-263, effective November 30, 2004, wherein Dr. Lipovsky did not contest the charge of filing a false medical note which resulted in a censure and reprimand, probation for two years and a $10,000 fine. Also, effective August 20, 1996, BPMC Order # 96-186 was issued, wherein Dr. Lipovsky admitted to having been convicted in New York State Supreme Court, County of New York of Criminal Facilitation in the Fourth Degree, which had resulted in a license suspension of five years with probation for five years and 250 hours of public service.

Therefore, the Chair believes that Dr. Lipovsky may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Lipovsky is prohibited from rendering treatment and care to injured workers while her authorization is temporarily suspended. Reports submitted by Dr. Lipovsky for services rendered prior to July 1, 2014, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Lipovsky for services rendered prior to July 1, 2014 should not be denied due to the suspension of her authorization.

This suspension remains in effect until further notice. Any questions regarding the authorized lists should be referred to the Medical Director’s Office at 1 (800) 781-2362.
