Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Zia Sheikh's authorization to treat injured workers within the New York State workers' compensation system effective June 23, 2014. Dr. Sheikh's last known business address is 4039 Route 219, Suite 102, Salamanca, New York.

The Chair's designee's investigation revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Order # 13-384, wherein Dr. Sheikh could not successfully defend against at least one of the acts of misconduct alleging negligence on more than one occasion and failing to maintain accurate patient records. As a result, Dr. Sheikh's license has been suspended for thirty-six months, stayed with probation for sixty months and he was fined $10,000. During Dr. Sheikh's probation, he may only practice medicine when his practice is being monitored by a licensed physician, board certified in an appropriate specialty.

Therefore, the Chair believes that Dr. Sheikh may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Sheikh is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Sheikh for services rendered prior to June 23, 2014, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Sheikh for services rendered prior to June 23, 2014 should not be denied due to the suspension of his authorization.
