Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Stephanie Bayner's authorization to treat injured workers within the New York State workers' compensation system effective December 31, 2013. Dr. Bayner's last known business address is 96-14 63rd Drive, Rego Park, New York 11374.

The Chair's designee’s investigation revealed that Dr. Bayner conducted multiple independent medical examinations (IMEs) and filed IME forms and reports without having authorization to do so. By filing reports and holding herself out as an IME provider without authorization to perform IMEs, and by providing an IME authorization number on forms and certifying that she was acting under IME authorization, Dr. Bayner may have violated WCL §§ 13-b(2), 137, 12NYCRR 300.2(2) 300.2(d), and WCL § 13-d(2)(d).

Therefore, the Chair believes that Dr. Bayner may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Bayner is prohibited from rendering treatment and care to injured workers while her authorization is temporarily suspended. Reports submitted by Dr. Bayner for services rendered prior to December 31, 2013, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Bayner for services rendered prior to December 31, 2013 should not be denied due to the suspension of her authorization.

This suspension remains in effect until further notice. Any questions regarding the authorized lists should be referred to the Medical Director's Office at 1 (800) 781-2362.
