Pursuant to Workers' Compensation Law Section 13-d(5), the Chair of the New York State Workers' Compensation Board has exercised his authority to revoke Dr. Loubert Suddaby's authorization to treat injured workers within the New York State workers' compensation system effective October 7, 2013. Dr. Suddaby's last known business address is 3775 Southwestern Blvd., Suite A, Orchard Park, NY 14127.
The revocation is based upon Consent Order (BPMC No. 13-301), issued by the New York State Department of Health, State Board for Professional Medical Conduct (BPMC), effective September 26, 2013.
Dr. Suddaby did not contest the charge of negligence on more than one occasion. As a result, his license was suspended, stayed with probation for thirty-six months and he was fined $10,000. Also, his license is limited in that he may only examine female patients in the presence of a chaperone and he must adhere to appropriate gowning requirements. During the period of probation, he may only practice medicine when monitored by a licensed physician, board certified in an appropriate specialty.
Dr. Suddaby is prohibited from rendering treatment and care to injured workers. Reports submitted by Dr. Suddaby for services rendered prior to October 7, 2013, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Suddaby for services rendered prior to October 7, 2013 should not be denied due to the revocation of his authorization.
