Pursuant to Workers' Compensation Law ("WCL") Section 13-d(2), the Chair of the New York State Workers' Compensation Board has exercised her authority to remove physical therapist (PT) Stephen Tolly's authorization to treat injured workers in the New York State workers' compensation system effective December 8, 2022. PT Tolly's last known business address is:

The Chair's designee's investigation has revealed that Mr. Tolly admitted to purporting to prescribe durable medical equipment to injured workers. Such conduct is outside the scope of Mr. Tolly's professional license and constitutes professional misconduct in connection with the treatment of injured workers and exceeds the limits of professional competence in rendering medical care to injured workers, all in violation of WCL §§ 13-d(2)(a) and (b).

Therefore, the Chair believes that PT Tolly may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

PT Tolly is prohibited from rendering treatment and care to injured workers. Reports submitted by PT Tolly for services rendered prior to December 8, 2022, are valid but are invalid for any services rendered on or after that date.
