The Chair has adopted, on an emergency basis, and proposed amendments to 12 NYCRR 309.3, as well as the addition of 309.4, to implement a recent Appellate Division case (Cisnero, 195 A.D.3d 1344), expanding the definition of "independent livery driver."

A Notice of Emergency Adoption and Proposed Rulemaking will be published in the December 29, 2021, edition of the State Register. This emergency rulemaking became effective as of the filing date on December 13, 2021, and expires 90 days from that date.
