Subject Numbers Regarding Health Provider Authorizations

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Paul Marcus' authorization to treat injured workers within the New York State workers' compensation system, effective May 15, 2020. Dr. Marcus' last known business address is:

The Chair's designee's investigation has revealed that the New York State Department of Education, Office of Professional Discipline, has issued Consent Order #31505, wherein Dr. Marcus did not contest the specification of misconduct, including that on or about May 23, 2017 as a court appointed therapist in a custody case, he prepared a report that contained inappropriate comments regarding the father in the custody matter and submitted said report to the Court. This resulted in a Censure and Reprimand, a $500.00 fine, and a one-year probationary period, during which Dr. Marcus must successfully complete a plan of continuing education in the areas of Ethical Practice of Psychology with Emphasis on Conducting Custody Evaluations and Multicultural Issues in the Practice of Psychology.

Therefore, the Chair believes that Dr. Marcus may be guilty of misconduct as described in Education Law §6509(9) and Section 29.2(a)(2) of the Rules of the Board of Regents (8 NYCRR), and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Marcus is prohibited from rendering treatment and care to injured workers, or to conduct reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a), while his authorization is temporarily suspended. Reports submitted by Dr. Marcus for services rendered prior to May 15, 2020 are valid but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Marcus for services rendered prior to May 15, 2020 should not be denied due to the suspension of his authorization.
