Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Anthony M. Leone’s authorizations to treat injured workers and to conduct independent medical examinations within the New York State workers’ compensation system, effective March 13, 2020. Dr. Leone's last known business address is:

The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued the Commissioner’s Order of Summary Action #20-042, wherein Dr. Leone was ordered to cease practicing medicine in the State of New York, or practice in any setting under the authority of his New York license. This decision is valid pending the final conclusion of a hearing regarding the allegations against him, including that on or about September 4, 2019, in the United States District Court, Western District of New York, he pled guilty to one felony count of Making Materially False Statements in violation of 18 U.S.C. §1001(a)(2) and one count of Unlawful Possession of a Controlled Substance in violation of 21 U.S.C. §844(a).
Therefore, the Chair believes that Dr. Leone may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.
Dr. Leone is prohibited from rendering treatment and care to injured workers, to conduct independent medical examinations, or to conduct reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a), while his authorization is temporarily suspended. Reports submitted by Dr. Leone for services rendered prior to March 13, 2020 are valid but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Leone for services rendered prior to March 13, 2020 should not be denied due to the suspension of his authorizations.
