Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Tonuca Basu’s authorization to treat injured workers within the New York State workers’ compensation system effective November 14, 2019. Dr. Basu's last known business address is:

The Chair’s designee’s investigation revealed that or about September 24, 2019, the Workers’ Compensation Board’s Office of General Counsel served Dr. Basu with a Notice to take her deposition regarding her care and treatment of injured workers. To date, Dr. Basu has failed and refused to appear for said deposition or to schedule any adjourned date for said deposition.
Therefore, the Chair believes that Dr. Basu may be guilty of misconduct pursuant to WCL § 13-d(2)(f) by refusing to testify at a deposition concerning her care and treatment of injured workers and that such misconduct would detrimentally affect the quality of care provided to injured workers.
Dr. Basu is prohibited from rendering treatment and care to injured workers and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a) while her authorization is temporarily suspended. Reports submitted by Dr. Basu for services rendered prior to November 14, 2019, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Basu for services rendered prior to November 14, 2019, should not be denied due to the suspension of her authorization.
