Pursuant to Workers' Compensation Law Section 13-d(2)(a) and (5), the Chair of the New York State Workers' Compensation Board has exercised her authority to remove Dr. Clarisse Clemons’ authorization to treat injured workers in the New York State workers’ compensation system effective May 6, 2019. Dr. Clemons’ last known business addresses are:

The removal is based upon Determination and Order BPMC #19-090, effective April 25, 2019, wherein the Hearing Committee of the New York State Department of Health, Board for Professional Misconduct sustained the findings that Dr. Clemons practiced medicine with negligence on more than one occasion in violation of Education Law §6530(3), that she practiced medicine with incompetence on more than one occasion in violation of Education Law §6530(5), that she ordered unwarranted tests/treatment in violation of Education Law §6530(35), and that she failed to maintain a record in violation of Education Law §6530(32).
Therefore, the Chair believes that Dr. Clemons may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.
Dr. Clemons is prohibited from rendering treatment and care to injured workers, and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a). Reports submitted by Dr. Clemons for services rendered prior to May 6, 2019, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Clemons for services rendered prior to May 6, 2019, should not be denied due to the removal of her authorization.
