Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Jaime Gabriel Gutierrez’s authorization to treat injured workers within the New York State workers’ compensation system effective October 16, 2017. Dr. Gutierrez's last known business address is:

The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Administrative Review Board (ARB) Determination and Order # 17-266, wherein the ARB affirmed the Committee’s Determination that Dr. Gutierrez failed to maintain accurate medical records, sustained the charge that he exercised undue influence to exploit patients for financial gain, affirmed the Committee’s Determination to impose a Censure and Reprimand, ordered that he complete a course in medical record keeping and CPT coding, and modified the Committee’s Determination by placing him on probation for five (5) years.
Therefore, the Chair believes that Dr. Gutierrez may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.
Dr. Gutierrez is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Gutierrez for services rendered prior to October 16, 2017 are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Gutierrez for services rendered prior to October 16, 2017 should not be denied due to the suspension of his authorization.
