Pursuant to Workers' Compensation Law Section 13-m(11), the Chair of the New York State Workers' Compensation Board has exercised his authority to revoke Dr. Jay A. Seitz’s authorizations to treat injured workers and to perform independent medical examinations in the New York State workers’ compensation system effective October 17, 2016. Dr. Seitz's last known business addresses are 590 West End Avenue, Suite 3A, New York, New York 10024, 450 7th Avenue, Suite 309, New York, New York 10023, and 321 E. 48th Street, Suite 1E, New York, New York 10016.

Dr. Seitz is currently under a temporary suspension from authorization to provide medical care and to perform IMEs of New York State workers’ compensation claimants. The temporary suspension was issued April 11, 2014, and was effectuated as of March 4, 2014.

Investigation has revealed that the United States Court of Appeals for the Second Circuit affirmed Dr. Seitz’s conviction of mail fraud, health care fraud and conspiracy to commit mail and health care fraud based on evidence that he (i) knew or consciously avoided knowing that certain insurance claim forms containing his signature falsely represented that he actually performed the treatments specified thereon, (ii) billed for treatment done by unlicensed social workers, and (iii) knew or consciously avoided knowing that certain insurance claim forms included medically unnecessary or fabricated treatments.

Dr. Seitz is prohibited from rendering treatment and care to injured workers and from performing independent medical examinations. Reports submitted by Dr. Seitz for services rendered prior to March 4, 2014 are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Seitz for services rendered prior to March 4, 2014, should not be denied due to the revocation of his authorizations.
