The Chair has adopted amendments to 12 NYCRR 309.3 and the addition of 309.4 to implement a recent Appellate Division case (Cisnero, 195 A.D.3d 1344), which expanded the definition of "independent livery driver."

The Notice of Emergency Adoption and Proposed Rule Making was adopted December 13, 2021, and published in the December 29, 2021, edition of the State Register. A Notice of Adoption will be published in the March 23, 2022, edition of the State Register.
