The Chair has adopted the amendment of Sections 442.2, and addition of sections 442.4 and 442.5 of 12 NYCRR to replace the Official New York Workers' Compensation Durable Medical Equipment (DME) Fee Schedule (DME Fee Schedule), update fees, and create a prior authorization process.

The Notice of Proposed Rule Making was published in the October 21, 2020, edition of the State Register. A Notice of Adoption will be published in the March 3, 2021, edition of the State Register. The amendments are currently scheduled to become effective June 7, 2021.
